One of the former subsidiaries of Yukos — Luxembourg Yukos Capital S.a.r.l- applies to the arbitration court for Samara district of Russia and to the Federal Court for the Southern District of New York in order to recognize and execute the decision of the International commercial arbitration dd. 15.08.2007 which ordered to «Samaraneftegaz», affiliated with Yukos, to pay $118 mln.

Yukos Capital decided to apply to the state court of New York, state where the decision was made.

Sergey Vodolagin explained that there are no legal reasons to apply to an American court which is competent only when a decision is planned to be performed in USA. This can be useful, however, for the future attempts for the recognition of the decision in other countries.
